11 States Sue Obama Administration Over Transgender Bathroom Guidelines

Image via Shutterstock On Wednesday, Texas and 10 other states filed a lawsuit against the U.S. government, over their recent directives regarding how public schools should treat transgender students as it relates to the bathroom. The complaint said that the Obama administration was out of line when issuing an “administrative fiat” on May 13 that said public schools should let transgender students use whichever bathroom matched their gender identity.

Texas is joined by Alabama, Wisconsin, West Virginia, Tennessee, Oklahoma, Louisiana, Utah Georgia, the Arizona Department of Education, and Maine’s Governor, Paul LePage. The complaint said:

Defendants have conspired to turn workplace and educational settings across the country into laboratories for a massive social experiment, flouting the democratic process, and running roughshod over commonsense policies protecting children and basic privacy rights.

The guidelines, released by the Departments of Justice and Education, claim that gender identity is protected by Title IX, so states could be at risk of losing federal funding if they do not comply with the guidelines.
